By making a booking, customers acknowledge the validity of these General Terms and Conditions of Forbidden Desire Escort Agency.

1. Booking request and booking

The agency arranges escorts for customers for a limited period of time and in return for payment. The agency receives a commission from the escorts for this service. The escorts offer their services in their own name and on their own account, i.e. they are self-employed entrepreneurs. Payments for the services of the escorts are made exclusively to them, not to the agency. All details regarding the services provided by the escorts are agreed between them and their clients. The contract is only concluded after consultation with the desired escorts and confirmation of the order by email or, if necessary, by telephone by the agency. New clients are requested to contact the agency by telephone before making their first booking. Minors are not permitted to use the agency’s services. The agency reserves the right to ask callers who appear to be particularly young to provide a copy of their ID to verify their age. If they do not comply with this request, no referral can be made.

2. Obligations of the Agency/Liability

The Agency endeavors to bring about a contract between clients and the desired escorts. It should be noted that pictorial and textual representations of the escorts are based on their information and templates. The Agency cannot guarantee the accuracy of this information and these templates.

The escorts act on their own responsibility and are not vicarious agents of the agency. The agency accepts no liability for the type, manner, or quality of the service provided. The agency is generally not liable for the actions of the escorts.

In all other respects, the following liability provisions shall apply: The Agency shall be liable without limitation insofar as damage to the Client is caused by the Agency’s fault—intent or gross negligence. The Agency shall be liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the customer regularly relies. Liability shall be limited to the foreseeable damage typical for this type of contract. The above limitations of liability do not apply in the event of injury to life, limb, or health, or in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected. Insofar as the Agency’s liability is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents.

3. Fees/Payment Methods

Detailed information about fees and any travel expenses incurred can be found in the profiles of the individual escorts. Customers shall hand over the agreed fee to the escorts in an unsealed envelope at the beginning of the date. All costs incurred (e.g., for travel, food, drinks/tickets for events, etc.) shall be borne by the customers.

For bookings with a total duration of 48 hours or more or a longer journey, a deposit of the agreed fee may be required. The agency will inform the customer of this separately at the time of booking. In this case, the deposit is transferred to an account of the agency. The payment is accepted by the agency in trust and forwarded to the respective escort lady. Before booking an escort lady for a longer period, the agency recommends getting to know her beforehand.

The dates can be extended without any problems in agreement with the escorts. The fee for the extension must be handed over to the escorts at the beginning of the extension.

4. Cancellation

Clients may cancel appointments that have already been arranged by email or telephone up to 24 hours before the start of the appointment. If a deposit has already been paid, this will be offset against another booking within 8 weeks of the cancellation. If the cancellation is made within 24 hours before the start of the appointment, the agency will retain any deposit paid without offering a replacement date.

If customers fail to attend the date without prior notification to the agency, the full amount payable for the date must be paid. Any deposits already paid will not be refunded.

Escorts may cancel the date in the event of persistent disruption or behavior by customers that is in breach of contract. In the event of cancellation for the aforementioned reasons, neither the fee nor the travel expenses incurred will be refunded.

If the date cannot be kept by the desired escort lady, the agency will offer the customer a date with another escort lady. If a placement is not in the customer’s interest, any deposit paid will be refunded. Other claims against the agency are excluded.

Clients and escorts are free to cancel the date after the first meeting. In this case, the agency expects to be notified of the cancellation of the date in a timely manner. In this case, clients are only required to pay the travel expenses incurred and a flat fee of EUR 100.00.

5. Data protection/prohibition of circumventing the agency

The agency processes personal customer data in accordance with the relevant data protection regulations. Detailed information on data processing can be found in the agency’s privacy policy.

Since the escorts predominantly pursue a reputable main profession, discretion is very important to them. Private contact with customers or private attempts to contact customers are not desirable. Customers will not ask escorts for their personal data or contact them directly, but will always use the agency to arrange a date.

6. Condom requirement/Other obligations of clients

Due to legal regulations in the ProstSchG, clients and escorts must use condoms during sexual intercourse. Violations of the condom requirement are an administrative offense and can be punished by the authorities with a substantial fine (for clients).

Clients will present themselves in the best possible light during the date and behave like true gentlemen. This means that clients will not ask escorts for their personal details or contact them directly, but will always use the agency to arrange a date.

Customers shall also ensure that the escorts are not endangered or harmed in their physical integrity or property during the date. Customers are liable for any damage caused to the escorts through their fault during the performance of the contract.

7. Final provisions

Should individual provisions of these terms and conditions be invalid or should the terms and conditions contain a loophole, the validity of the remaining provisions shall remain unaffected. The respective statutory provisions shall apply in place of the invalid or missing provisions.

German law shall apply. Customers who are resident abroad may, irrespective of this, always invoke the law of the country in which they are resident.
